The new DIFC Data Protection Law 2020 (“DPL 2020”) came into force on 1 July 2020. DPL 2020 aims to enhance the existing legal framework on data protection in the DIFC. DIFC businesses have until 1 October 2020 to prepare to comply with DPL 2020.

New features:

  • Consent needs to be clear and freely given
  • Appropriate records of processing activities (ROPA) are required
  • High risk processing requires data protection impact assessments (DPIAs)
  • Appointing a Data Protection Officer (DPO) may be necessary
  • New requirements for transfers outside of the DIFC exist, including the UAE
  • There are new and enhanced data subject rights
  • Personal data breach obligations
  • A new fines regime
