On 30 November 2016, the Supreme People’s Court issued the Minutes of the Eighth National Work Meeting on Civil and Commercial Court Trials (Civil Part). Employers should pay special attention to the rulings on liquidated damages for a violation of non-compete obligations and the legal risks for the unilateral termination of an employment contract by way of “elimination of the worst performing employees” or “competition for work positions”.
